Privacy policy

This privacy policy explains which personal data we process when you visit our website and when you contact us. It is based on the Swiss Federal Act on Data Protection (FADP). Where the EU General Data Protection Regulation (GDPR) applies, it also applies accordingly under the GDPR.

2. Contact form and getting in touch

If you contact us via the form, by email or by phone, we process the details you give us: subject, name, company, email address, phone number and your message. We use them exclusively to answer your enquiry, prepare a conversation and, where appropriate, prepare a quotation. The legal basis is your consent and our interest in answering enquiries (or Art. 6(1)(a), (b) and (f) GDPR).

Enquiries via the form are stored in our Wix account and created there as a contact; enquiries by email arrive in our mailbox. We delete them no later than 24 months after the last contact unless an assignment results. If an assignment results, we keep business-relevant documents for as long as required by statutory retention obligations (usually ten years, Art. 958f CO).

We do not sell your data, do not send newsletters and only pass on your details if this is necessary to process your enquiry (for example to Advancis as part of a joint project) or if we are legally obliged to do so.

Sending the contact form

The contact form runs on Wix Forms, a service of Wix.com Ltd. (see section 3). Your details are transmitted to Wix in encrypted form, stored there and shown to us in the Wix dashboard. Wix processes the data as a processor on our behalf and only according to our instructions; the basis is Wix’s Data Processing Agreement. For the transmission, the website uses an anonymous Wix visitor token that is only valid for sending and is not stored. If you do not want to use the form, write to us directly at info@es-rose.ch or call us.

3. Hosting with Wix

Our website runs on Wix, a service of Wix.com Ltd., Nemal Tel Aviv St. 40, 6350671 Tel Aviv, Israel. When the website is accessed, Wix processes technically necessary data such as IP address, date and time, page accessed, referrer as well as browser and device information in order to deliver the website, secure it and prevent misuse. Wix stores data on servers and with service providers in various countries, including the USA. For fast and secure delivery, Wix uses content delivery networks, including that of Cloudflare, Inc. (USA). These also process the technical data mentioned, in particular the IP address, and protect the website against attacks and automated access.

According to the Federal Council (Annex 1 of the Data Protection Ordinance) and the European Commission, Israel ensures an adequate level of data protection. For transfers to the USA, Wix and Cloudflare are certified under the Swiss-U.S. and EU-U.S. Data Privacy Framework; standard contractual clauses are used in addition. 4. Cookies

When the website is accessed, only technically necessary cookies are set: __cf_bm from Cloudflare, to distinguish people from automated access (bots) and protect the website against misuse (stored for 30 minutes), and sec-fetch-unsupported from Wix for technical delivery (until the end of the session). These cookies contain no information about you and are not used for advertising or statistics.

We do not use advertising or marketing cookies. Should we use visitor statistics in future, we will ask for your consent via a cookie banner. You can delete or block cookies in your browser at any time; some functions of the website may then be restricted.

5. Local storage in the browser

For the duration of your visit, the website stores two technical values in your browser’s session storage: whether the intro has already been shown and which subject you selected, so that it is preselected on the contact page. These values do not leave your browser and are deleted when you close the tab.

6. Fonts and software libraries

Fonts and the software libraries for smooth scrolling and 3D graphics are delivered together with the website from our hosting. No data is transmitted to Google or other third parties for this, and no cookies are set.

The website does not embed any Google maps. The link “View on Google Maps” only opens our company profile on Google when you click it; from then on, Google’s privacy policy applies.

7. Data security

The connection to the website is encrypted (HTTPS). Only the people at E&S Rose who handle enquiries have access to them.

8. Your rights

You can request information about the personal data we hold about you at any time, request its correction or deletion, object to processing and withdraw consent you have given. You also have the right to receive your data in a common format. To do so, contact info@es-rose.ch. You can also lodge a complaint with the Federal Data Protection and Information Commissioner (FDPIC, edoeb.admin.ch) or, where the GDPR applies, with a supervisory authority in the EU.

9. Changes

We adapt this policy when the website or the services used change. The version published here at any given time applies.
